Spotlight On Coaches Contest (the “Contest”) starts on January 1, 2010 at 12:01 AM Eastern Time (“ET”) and ends on December 31, 2010 at 11:59 PM ET (“Contest Period”). The Contest will also include three (3) monthly nomination periods (each, a “Monthly Nomination Period”): The first Monthly Nomination Period will begin on January 1, 2010 at 12:01 AM ET and end on January 31, 2010 at 11:59 PM ET, the second Monthly Nomination Period will begin on February 1, 2010 at 12:01 AM ET and end on February 28, 2010 at 11:59 PM ET, and the third Monthly Nomination Period will begin on March 1, 2010 at 12:01 AM ET and end on March 31, 2010 at 11:59 PM ET.

ELIGIBILITY: Contest is open to nominees who are legal residents of the forty-eight (48) United States or the District of Columbia (excluding Alaska and Hawaii), who are at least 18 years of age and sports educators or coaches at an accredited public or private secondary school within the forty-eight (48) United States or the District of Columbia (excluding Alaska and Hawaii) (grades seven through twelve) and nominators who are legal residents of the forty-eight (48) United States and the District of Columbia (excluding Alaska and Hawaii), who are at least thirteen (13) years of age within the forty-eight (48) United States or the District of Columbia (excluding Alaska and Hawaii). Employees, officers and directors of National Fluid Milk Processor Promotion Board (“Sponsor”) and NBA Media Ventures, LLC, NBA Properties Inc, (collectively, the "NBA Entities"),Weber Shandwick, and their respective parents, subsidiaries, affiliates, promotion and advertising agencies and members of their immediate family (spouse, mother, father, sister, brother, ward, daughter or son and their respective spouses, regardless of where they reside) and persons living in the same household of such employees, whether or not related, of each of the above, are not eligible to enter or win. Nominators should obtain the Nominee’s permission to enter him/her into this Contest. An eligible minor must have his/her parent’s or legal guardian’s permission to enter. Void in AK, HI and where prohibited. Contest is subject to all applicable federal, state and local laws.
Students, sports educators and coaches should confirm with their school that participation in promotions of this type are permitted under school policies, and students, sports educators and coaches from schools that prohibit or restriction participation in these types of promotions are not eligible.

HOW TO ENTER: During the Contest Period, to enter and nominate your coach, visit milkdelivers.org and follow the directions provided to write and submit an essay explaining how your school coach makes post-exercise nutrition a part of his/her athletes’ training routine and how he/she focuses on lowfat chocolate milk for recovery and fill out the entry form, and submit (hereafter, the “Nomination”). Each Nomination is limited to 100 words or less. All Nominations must be received by 11:59 PM ET on the last day of the applicable Monthly Nomination Period to be considered for that Monthly Nomination Period and by 11:59 PM ET on December 31, 2010 to be considered for the Grand Prize. Nominations generated by script, macro or other automated means and Nominations by any means which subvert the Nomination process will be void. Limit one (1) Nomination per nominator, per email address, and per household for the duration of the Contest Period. Nominations received from any nominator, email address or household in excess of the stated limitation will be void. All Nominations become the sole property of the Sponsor and will not be returned.
Each Nomination must be nominator’s own original work, be in English, be in keeping with the Sponsor’s image, may not have been previously published, may not have won previous awards, as determined by Sponsor in its sole discretion, nor can Nomination infringe upon the copyrights, trademarks, or other intellectual property of any person or entity and may not be offensive or inappropriate, as determined by the Sponsor in its sole discretion, nor can it or defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. If any Nomination contains the names or likenesses of any third party, the nominator is responsible for obtaining, prior to submission of the Nomination, any and all releases and consents necessary to permit the use and exhibition of the Nomination by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any nominator at any time. Failure to provide such proof may, if requested, result in the Nomination being voided. By submitting a Nomination, nominator (and, if an eligible minor, his/her parents or legal guardian) warrants and represents that he/she and any persons who are identifiable in the Nomination consent to the submission and use of the Nomination in the Contest and to its use as otherwise set forth herein.
By submitting a Nomination, nominator (and, if an eligible minor, his/her parent or legal guardian) acknowledges and agrees that Sponsor may obtain many Nominations under this Contest and that such Nominations may be similar or identical in theme, idea, format or other respects to others submitted under this Contest and/or other materials or promotions developed, staged and/or sponsored by the Sponsor or its agents and contractors, and waive any and all claims nominator may have had, may have, and/or may have in the future, that any composition and/or other works accepted, reviewed and/or used by the Sponsor (or its designees) may be similar to his/her Nomination. Except where prohibited by law, each nominator (acknowledges and agrees that the Sponsor does not have now, nor shall it have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to nominator’s Nomination.

MONTHLY NOMINATION JUDGING: All eligible Nominations received for each Monthly Nomination Period by Sponsor will be judged by a panel of qualified judges based equally on the following criteria: Ability to effectively and accurately convey how nominee makes post-exercise nutrition a part of his/her athletes’ training routine; Creativity of post-exercise program focused on lowfat chocolate milk for recovery; Originality of post-exercise program focused on lowfat chocolate milk for recovery (collectively, the “Judging Criteria”). The Nomination with the highest score for the applicable Monthly Nomination Period will be deemed the potential First Prize winner for that Monthly Nomination Period. In the event of a tie for any Monthly Nomination Period, an additional, “tie-breaking” judge will determine the winner based on the Judging Criteria. Sponsor reserves the right not to award a prize for any Monthly Nomination Period if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Nominations. Non-winning Monthly Nominations from one Monthly Nomination Period will carry over into subsequent Monthly Nomination Periods and all Nominations will be included in the judging for the Grand Prize.

GRAND PRIZE JUDGING: All eligible Nominations received by Sponsor for the entire Contest Period will be judged by a panel of qualified judges based on the Judging Criteria. The Nomination with the highest score will be deemed the potential Grand Prize winner. In the event of a tie, a “tie breaking” judge will determine the winner based on the Judging Criteria. Sponsor reserves the right not to award a Grand Prize, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Nominations.
Awarding of prizes is subject to verification of eligibility and compliance with these Official Rules. Prizes will be awarded to nominators, as opposed to nominees Judges’ decisions are final and binding on all matters relating to this Contest.
Potential winners (nominated coaches) and their nominees and their schools will be notified by telephone, mail and/or email approximately 10-14 days following the applicable judging. Potential winners, nominees (and if eligible minors, their parents or legal guardians) and an authorized representative of each potential First Prize winner’s school will be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), which must be returned within fourteen (14) days of date appearing on prize notification. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within fourteen (14) days of issuance, Sponsor’s inability to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner and/or his/her nominee will result in disqualification and the prize may be awarded to a runner-up at Sponsor’s sole discretion. If any nominator of a potential winner is at least 13 but still considered a minor in his/her jurisdiction of residence, prize will be awarded in the name of his/her parent or legal guardian, and such parent or legal guardian will be required to fulfill all requirements imposed on nominators of potential winners set forth herein.

PRIZE(S): Grand Prize (1): Grand Prize winner will be featured in a trade magazine as a Milk Mustache Trade Celebrity. Exact trade magazine and insertion date will be determined by Sponsor in its sole discretion. Sponsor does not guarantee Grand Prize winner’s appearance in a trade magazine. Approximate Retail Value (“ARV”) of Grand Prize: $500.00. First Prizes (3) (one (1) for each Monthly Nomination Period): First Prize winners will receive a local NBA player appearance at their school plus $1,000 awarded in the form of a check made payable to the school to use towards its sports programs. One winner will be selected each month from January, 2010 to March 2010. (ARV of First Prizes: $1,000.00 each Date of appearance of basketball player will be held on a date prior to June, 2010 to be determined by Sponsor. Appearance of player is subject to availability. All appearance details including length and actual basketball player to appear, will be determined by Sponsor.

GENERAL PRIZE CONDITIONS: Total ARV of all prizes awarded: $3,500. All prize details not specified herein as being awarded will be at the sole discretion of the Sponsor. No substitution, transfer, or cash equivalent of prize (or portion thereof) is permitted, except by Sponsor, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Any and all federal, state, and local taxes on the prizes, and any other costs, fees, and expenses associated with prize acceptance and use not explicitly stated herein as being awarded, are the sole responsibility of the winners and the school athletic departments of such winners (as applicable).

GENERAL: By participating, each nominator (and, if an eligible minor, his/her parent or legal guardian) and nominee agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, the NBA Entities, Weber Shandwick, and their respective parents, affiliates, subsidiaries, retailers, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from his/her participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded prize (including any activity related thereto); and (c) to the use of his/her name, voice, performance, photograph/video, Nomination, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation, notification (unless prohibited by law) or additional consents from nominator or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

OWNERSHIP/USE OF NOMINATIONS: By submitting a Nomination, each nominator (and, if an eligible minor, his/her parents or legal guardian) agrees Sponsor shall own the Nomination submitted (including all rights embodied therein) and Sponsor and its designees may edit, publish, use, adapt, exploit, modify, copy, disseminate or dispose of any Nomination, the concepts embodied therein or any elements thereof, proper names, online, in print, film, television, or in any other media now known or hereafter devised for advertising and promotional purposes worldwide in perpetuity without compensation or notification to or permission from the nominator of any kind, except as prohibited by law.
Released Parties are not responsible for lost, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Nominations; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Nominations, the cancellation or postponement of an NBA player’s appearance, the announcement of the prizes, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Nominations will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Nominations, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest (or portion thereof) and, if terminated, at its discretion, select the potential winner(s) for the Monthly Nomination Period(s) at issue and/or the Contest Period from all eligible, non-suspect Nominations received for the applicable Monthly Nomination Period(s) and/or Contest Period prior to action taken using the judging procedure outlined above. In the event of a dispute, the name of the “authorized account holder” associated with any given email address will be deemed to be the nominator and he/she must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
