The Milk “Spotlight On” Contest for School Foodservice Professionals
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT IMPROVE ONE’S CHANCES OF WINNING.
- SPONSOR: The National Fluid Milk Processor Promotion Board (“Sponsor”), 1250 H Street NW, Suite 950, Washington, DC 20005.
- HOW TO ENTER: The Milk “Spotlight On” Contest (“Contest”) is being conducted by the Sponsor, during the period commencing at 12:01 AM Eastern Time (“ET”) on January 1, 2011 and ending at 11:59 PM (ET) on December 31, 2011 (“Contest Period”) unless otherwise noted. Entry is accomplished by completing the online entry form found at www.milkdelivers.org and telling your success story on how you increased milk consumption. Please see below on judging criteria.
- ELIGIBILITY: Contest is only open to legal residents of the 48 contiguous United States and the District of Columbia, who are employed by or officially affiliated with participating schools or school district food service activities. All entrants will be referred to as Participant on these Official Rules. Applicants agree to abide by these official rules and the judges' decisions, which are final.
- LIMITATIONS: All entries must be received during the Contest Period. Limit one entry per person. Employees, officers and directors of Sponsor, its respective subsidiaries, affiliates, distributors, sales representatives and advertising, promotion and fulfillment agencies (individually and collectively, “Entities”); and members of their households and immediate families are ineligible to enter or win. The Entities are not responsible for entries from persons who are not Participants; or for lost, incomplete, inaccurate, fraudulent, illegible, mutilated, unintelligible, and defective, tampered with, stolen, destroyed, altered, unauthorized, non-delivered, delayed, late or misrouted entries or for any printing or production errors. All such entries are ineligible and will be disqualified. This Contest is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations.
- JUDGING CRITERIA: All entries received will be judged by representatives of the Sponsor (“judges”). Decisions of the judges are final on all matters relating to this Contest. Entries will be judged based on the following criteria: 1) Milk Consumption Data ? the increase in milk consumption among your school or school district or the increase in your milk sales (50%); 2) Innovativeness ? the creativity of your milk program (25%) and 3) Level of Program Support ? the ideas that supported your milk program (25%). The judging process will be completed on or before the second Friday of each month during the Contest Period to determine the Monthly winners. Non-winning entries will be entered into the subsequent monthly judging process. All monthly winners’ entries will be reviewed at the end of the Contest Period to be declared a Grand Prize winner. There will be one Grand Prize winner. The top scoring entry will be declared the Grand Prize winner. In the event of a tie, the winner will be determined based on the highest score for Milk Consumption Data. In the event of a further tie, winner will be determined based on the highest score for Milk Consumption Data and Innovativeness.
- PRIZES / APPROXIMATE RETAIL VALUES ("ARV"): A total of one (1) Grand Prize and up to 12 Prize Packs (one awarded each month). The Grand Prize winner will be featured in approximately three (3) trade magazines as a Milk Mustache Trade Celebrity. There is no ARV associated with the Grand Prize. Each Prize Pack consists of: a 1GB iPod Nano (ARV: $140.00) for the winner and a Barrel Cooler (ARV: $200.00) for the winnerÕs school or school district. If the winner is a representative of a school district, then they may give the Barrel Cooler to the school of their choice in their district. Maximum ARV of all prizes: $4,080.00.
- WINNER’S NOTIFICATION: Monthly Prize winners will be notified by phone or email, on or before the third Friday of each month during the Contest Period. Grand Prize winner will be notified by phone or email, on or before February 16 of year following the contest year. All legal responsibilities of a minor under the Official Rules will be assumed by a Parent. Disqualification and the selection of an alternate winner may result from the following: failure of a potential winner to respond to phone call or email within ten (14) business days from the date of transmission.
- WINNERS’ LIST (available after February 17 of year following the contest year): All winners can be found on milkdelivers.org.
- CONDITIONS: Each Participant by entering this Contest agrees and acknowledges that:
- he/she will abide by and be bound by the Official Rules and Sponsor’s decisions;
- the entry becomes solely the Sponsor’s property and will not be acknowledged or returned;
- none of the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize or participation in this Contest;
- winner’s acceptance of the prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law;
- in the event of unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Contest, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend this Contest; and in such event, to select winners from among all eligible entries received up to such time of cancellation, termination or suspension;
- the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Official Rules and selection and announcement of the winners;
- any portion of the prize not accepted by the winner will be forfeited;
- the Releasees are not responsible for any inability of the winner to accept or use the prize (or any portion thereof) for any reason;
- the entry and the elements thereof were created and/or rendered at Sponsor’s request and constitute a “work-made-for-hire” as defined in the United States Copyright Act of 1976, as amended;
- Sponsor is the author of said “work-made-for-hire” and the owner of all rights in and to all elements of the entry throughout the universe, in perpetuity and in all languages, for all now known or hereafter existing uses, media and forms, including, without limitation, the copyrights therein and thereto (including all extensions and renewals thereof);
- Sponsor shall have the right to make such changes to the entry and such uses of the entry as it deems necessary or desirable, including the right to use, edit, and reproduce and/or alter said entry in perpetuity, without additional compensation, in its entirety or in part, for all commercial and promotional purposes worldwide without consultation or additional compensation, and the right to edit any and all trademarks, third party references or images and/or any other content of the entry;
- to the extent that the entry and/or any of its elements is/are not recognized as a “work-made-for-hire”. Participant hereby assigns, transfers and conveys to Sponsor, without reservation, all of his/her right, title and interest in and to the entry and its elements throughout the universe, in perpetuity and in all languages, for all now known or hereafter existing uses, media and forms, including, without limitation, the copyrights therein and thereto (including all extensions and renewals thereof);
- the entry may not include any trademarks, trade names or copyrighted works of any corporations or entities other than Sponsor;
- by acceptance of the prize the winner agrees that he/she will be available to participate in any and all public relations activities requested by Sponsor or Sponsor’s designated agency at no additional compensation (to the extent permitted by law), except that travel expenses incurred by winner will be paid for by Sponsor;
- each entry must be a Participant’s own original creation and certify no other person or entity holds rights to the entry.
- Participant must be willing to undergo a background check conducted by the Sponsor (if necessary) and
- an entry is void if indecent or obscene.
